Terms and conditions

These terms and conditions of sale set out how you (the client) can make purchases from Abby’s Cakes website.

Please read them carefully. I pride myself in providing a high level of customer service, ensuring that you are clear in respect to all of your rights relating to your purchase. Ahead of making any purchase you will be asked to tick a box stating ‘I agree to Abby’s Cakes Terms and Conditions’. In ticking that box, you will be accepting the terms set out below.

PRICES 
All prices are non-negotiable and priced according to your specific design and size of cake. The price for your order shall be stated via email. You agree to pay the full price to Abby’s Cakes, in accordance with your order, after the details are checked and agreed by you. 

Following your consultation or email enquiry I will provide you with a quote, which is valid for 14 days for Celebration cakes or 30 days for Wedding cakes.

DEPOSITS
Celebration cakes
For Celebration cakes quoted over £100 a non-refundable deposit of £10 is required to secure your booking date, following your enquiry. The quote is valid for 5 days and paying the deposit secures both the price quoted and chosen date. I reserve the right to cancel the order if the deposit is not paid within 5 days of the quote. For orders placed at short notice (less than 10 days), payment will be required, in full, within 24 hours.

For a Celebration cake under £100, payment will be required, in full, 24 hours before your order is due to be collected or delivered.

Wedding cakes
All Wedding cake orders require a non-refundable deposit. After your consultation or email enquiry, I will provide you with a quote and your date will be saved for 30 days. If you decide to proceed with the order I will require a £50 booking deposit payment, which will be required, in full, within 24 hours. The deposit will be deducted from your final total payment.

PAYMENT
– Payment may be made by BACS, PayPal or cash on delivery/collection.
– Final payment for your Wedding cake is required 7 days before the collection or delivery. 
– Final payment for Celebration cakes (over £100) is required 7 days before the collection or delivery. 
– Final payment for your Celebration cake (under £100) must be made 24 hours prior to delivery or collection.

CANCELLATION
– Celebration cakes (under £100): 2 weeks or more. 
– Other Celebration cakes (over £100): 4 weeks or more (25% non-refundable deposit will be retained). 
– Wedding cakes: 12 weeks or more (50% non-refundable deposit retained). 

Change of date
If for any reason you wish to re-arrange the date of your event or wedding, I will endeavour to accommodate your request. This is providing the date is available with myself, to avoid any additional charges, otherwise it will be treated as a cancellation (please see above).

COMPLAINTS AND REFUNDS
Should you be unhappy with any aspect of your order please notify me upon receipt so that I am given the opportunity to rectify it. Refunds will not be given for change of mind.

DESIGN
Your cake is very important to me. Please take the time to check the details of the design and quote provided before agreeing to proceed. If you need to make any amendments please let me know within three days.

It is your responsibility to advise me of any required alterations to the original order. If the changes affect the cost, or if preparations have begun on the original design, I will advise of any adjustments to the remaining balance. Financial adjustments will need to be agreed to by both parties before alterations can take place.

Variation includes; change of design, change of supply date and change of delivery location. Whilst every effort will be made to assist, please note that I can’t guarantee late changes.

I reserve the right to change the design at any point if there are circumstances beyond my control (such as melting due to the weather) may compromise the finish of the cake.

All of my cakes are made individually, by hand, so there may be some variation from the design requested or the picture supplied. 

ALLERGIES & SPECIAL DIETARY REQUIREMENTS
Special Dietary Requirements
Please notify me if you or any guests have any special dietary requirements. Cakes can be made gluten free, dairy and alcohol free. 

Allergies

All of my products contain wheat, dairy, eggs and so on. Ingredients such as nuts can be removed from products but they are still used in my kitchen (along with other allergens) so I cannot guarantee that my products are completely free from them, as some ingredients are not guaranteed nut free by the manufacturers. Allergy information is provided with all cake orders.

Non-edible items
Some of my cakes contain small proportions of non-edible items such as; support dowels (in tiered cakes), ribbon, florist wires (in sugar flowers)), flower picks, floral tapes, cocktail sticks and any other parts discussed with Abby’s Cakes. You will be advised of the placement of such items, but it is the clients responsibility to ensure that these items are removed by yourself/caterer/guests prior to consumption. 

Cake Component Parts
From time to time certain materials for my cakes may become obsolete or no longer available from suppliers, for example, pre-manufactured items or items from abroad. This is totally out of my control, however I will endeavour to re-design a cake as closely as possible to the original design using replacement products.In all cases I will contact you to advise you of such changes, however I do reserve the right to replace these components of equal or better quality without consultation.

DELIVERY CONDITIONS
Cakes can be delivered by prior arrangement with Abby’s cakes. It will be delivered at the time and address agreed with the client. It is the clients responsibility to ensure someone is available to accept the delivery. Cakes should be inspected upon receipt to ensure that they were not damaged in transit, as you (or any third party taking delivery e.g. wedding venue/hotel etc.) shall be solely responsible for any damage which occurs after delivery of products, or as a result of failure to follow any instructions or advice given in respect of storage, setting up or further transportation.

Please note that in extreme weather conditions such as; heavy snow, flooding, gale force winds etc. I may not be able to deliver if conditions are considered too dangerous to travel. Whilst your delivery charge will be refunded, Abby’s Cakes cannot be held liable for the failure of delivery in these circumstances.

Similarly, in heatwave conditions your cake is susceptible to softening, melting and potential damage in transit. Although the above circumstances are extremely rare Abby’s Cakes will not be held liable for non-delivery or damage in transit in these circumstances.

COLLECTION CONDITIONS
On the day of collection, your order may be collected at a pre-arranged time, as agreed with Abby’s cakes. I will provide you with the necessary assembly instructions. Extreme care should be taken during transportation. The cake must be positioned on a flat surface, such as a boot (car seats are not suitable). Sudden braking and sharp turns must be taken into consideration and if the weather is warm ensure you have the air conditioning on throughout the journey.

Please note that once the product has been collected, full responsibility for the product lies with the client. Abby’s cakes assumes no responsibility for any damage that may occur once the cake has left the premises.

STORAGE & CONSUMPTION
Portions guide

The portion guides are intended as a guide only. The final number of servings will vary depending on how the cake is cut. Abby’s Cakes provides a cake cutting guide on this website to show how to cut the number of portions from your cake.

Storage Conditions 
Your cake is made entirely of natural ingredients, and baked to ensure it is fresh for the date of your event – it will not have the extended shelf life of most supermarket cakes, which contain additives and preservatives. I cannot guarantee cake quality if it’s consumed more than 48 hours after the event.

Sugar paste sponge cakes should not be refrigerated, as this will cause condensation on the icing and also accelerates the staling of the flour. 

Freezing the cake however, preserves the taste of the sponge and icing as much as is feasibly possible, but please bear in mind that the visual appearance of the icing will be affected by defrosting. Food hygiene recommendations advise that it is frozen for a maximum of 3 months.
